APPLICATION OF THE CONVENTION ON THE PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE IN THE GAZA STRIP
(SOUTH AFRICA v. ISRAEL)


ICJ orders: "Israel must take all measures in its power to stop anything in relation to genocide in Gaza, to prevent and punish those involved with inciting genocide against Palestinians in the Gaza Strip, to take immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance".

ICJ President Joan E. Donoghue; outlined the provisional measures and how each judge voted:
  • The court voted 15-2 on the order that Israel must take all measures in its power to stop anything in relation to genocide in Gaza.
  • By 16 votes to 1, the court voted that Israel needs to take all measures within its powers to prevent and punish those involved with inciting genocide against Palestinians in the Gaza Strip.

Public Argument + Concern
Public argument + concern arises i.e. if the term 'ceasefire' should have been included or used in the ICJ Order; instead of the term 'stop'.

Legal Experts Argument from Legal Perspectives
It is not necessarily to use 'ceasefire' as the term suggest a 'temporary' order (see definitions below). This may open-up more arguments.
The term 'stop' is more powerful and carries more weight as compared to 'ceasefire'.

ICJ, in its own full legal expertise, rights and authority, has indeed thoroughly, carefully and precisely used the term 'stop' in its Order; as to clearly instruct the defendant i.e. "Israel must take all measures in its power to stop anything in relation to genocide in Gaza, to prevent and punish those involved with inciting genocide against Palestinians in the Gaza Strip, to take immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance to stop its genocides against the Palestinian".

Summary
  1. The ICJ Order has fully-addressed the Order; taking into consideration various legal aspects and requirements.
  2. Any attempts or narratives to influence, challenge and or reject the ICJ Order;

    1. - is indeed a clear and blatant ignorance of the legal venue, and
